Embattled Tesla is still soldiering on in New Jersey courts for the right to sell its cars directly to customers.
The American automaker is arguing that New Jersey regulators don’t have the authority to shut down the direct sales of its electric vehicles in the state and is currently appealing a rules change made in March by the New Jersey Motor Vehicle Commission. Representatives for dealers in the state believes that the conflict will likely be resolved before Tesla’s regulatory challenge is even heard.

In the recent filing, Tesla argues that the state’s statute doesn’t apply to the company because it has no franchisor-franchisee relationships, as well as noting that the New Jersey Motor Vehicle Commission has limited powers and is not entitled to enforce the franchise statute anyways. The company also believes that certain elements of the rule previously have been found to violate the New Jersey Constitution.
At least two bills are pending in the New Jersey Senate that would give the company an exemption to sell directly at up to four stores in the state – it currently has two.
